Black Sherif wins court case over Cruise People Ltd for allegedly breaching performance contract.
The Accra High Court has dismissed a case filed against Ghanaian musician Black Sherif by Cruise People Ltd.
The company had accused the artist of breaching an agreement that led to the cancellation of the ‘Afro Cruise Jam’ concert in Athens, Greece, where Black Sherif was scheduled to perform in August 2023. Cruise People claimed financial losses due to the cancellation and sought compensation from Black Sherif.
In response, Black Sherif’s legal team argued that the court lacked jurisdiction to hear the case, as the performance contract specified that legal proceedings should take place in the United Kingdom.
Despite Cruise People’s assertion that the court had jurisdiction since both parties were Ghanaians operating in Ghana, the court, led by Judge Mariama Sammo, sided with Black Sherif’s lawyers.
The judge emphasized that none of the addresses provided by the party engaging the artist were located in Ghana. Consequently, the court had no choice but to dismiss the case against the acclaimed music star.
Cruise People Limited, the company entangled in a contractual dispute with Ghanaian musician Black Sherif, recently initiated legal proceedings against the artist.
The lawsuit, filed in the High Court, alleges that Black Sherif failed to fulfill his contractual obligations, resulting in the cancellation of the highly anticipated Afro Cruise Jam concert in Greece, where he was scheduled to perform.
Cruise People Limited claims to have secured Black Sherif’s services for the cruise event by paying half of his $20,000 booking fee. As part of the agreement, the company expected the artist to record a video confirming his participation.
Allegedly, Black Sherif did not fulfill this aspect of the agreement, leading to the cancellation of the booking and incurring a substantial financial loss of $18,000 from reserved cabin bookings on the cruise ship.
The organizers argue that Black Sherif’s failure to confirm his participation jeopardized the entire event, as his presence was crucial for attracting patrons. Considering this a significant breach of the agreement, Cruise People Limited is seeking legal recourse.
The lawsuit aims to recover the $20,000 booking fee and seeks compensation of $18,000 to cover the costs of lost cabin bookings. Additionally, the company is requesting interest on the $20,000 from April 18, 2023, until the final payment date, along with a claim for $50,000 in lost profits attributed to the alleged breach of contract.
