    Court strikes out Davido’s preliminary objections to Pinnick’s contract breach suit

    The preliminary objections made by renowned musician David Adeleke, also known as Davido, and his company, Davido Music Worldwide, were dismissed by a Delta State High Court in Effurun.

    About the yearly “Warri Again Concert,” Amaju Pinnick and Brownhill Investment Company Limited filed a breach of contract lawsuit against Davido and his legal team. Davido and his team had contested the High Court in Effurun, Delta state’s jurisdiction to hear the case.

    The singer was criticized by Pinnick, a former president of the Nigeria Football Federation, for not performing at the event even though she was paid $94,600.

    He had said last October: “We paid Davido $94,600 on the 6th of April. We paid $18,000 for his plane. If he says he’s a big boy, we will tell him we are bigger than him.”

    Through Kelechi Onwuegbuchulem, his attorney, Pinnick is requesting a N2 billion general damages award against Davido and his record company.

    The claimant is pleading with the court to provide Davido with N150 million in legal and professional expenses in addition to an extra N30 million to cover the cost of bringing the lawsuit.

    Additionally, he requests that the artist publicly apologize to Pinnick and the attendance for four days straight on all of his social media platforms and in two daily newspapers across the country.Since the claimant had not sent a letter of demand demanding restitution of the money they had claimed in the complaint, the defendants contended that the litigation was premature and that it was a debt collection matter.

    However, in its ruling on Wednesday, the court rejected their arguments.

    The claimant’s attorney argued that to appreciate the essence of the litigation, the claimed reliefs should be taken into account collectively rather than separately, and the court accepted this point of contention.
